1. Who we are
Perchia is a service of [RAZÓN SOCIAL] ([NIF], [DOMICILIO], hola@perchia.app). These terms are the agreement between you and us for using the private beta of Perchia on the web and on the iPhone app. By creating your account you accept them. Read them with the Privacy notice, which explains what we do with your data.
2. What the beta is
- Perchia dresses you from your own clothes: you say where you're going and it suggests outfits from the pieces you've photographed, with the weather and the time, and it can draw you wearing the outfit.
- It is a free, private, invitation-only beta, from 23 November 2026 until [BETA END DATE] or until we tell you it ends. It is a test version: it may have errors, change, fail or be interrupted.
- You have a monthly limit of pictures ("See it on me"): [30] during the beta. We'll tell you how many are left.
- We charge you nothing. If paid plans come later, we'll offer them separately, and you will never move to a paid plan without expressly accepting it. [PLACEHOLDER: paid plans will have their own terms.]
- We will ask for your opinion. Answering is voluntary.
3. Who can use it
- People aged 18 or over invited by Perchia. By signing up you confirm you are 18 or over.
- One account per person, for your personal, non-commercial use.
- If you are under 18, you may not use Perchia. If we learn an account belongs to a minor, we will close it and delete its data.
4. Your account
- You sign in with a link we email you or with your Google account.
- Look after access to your email: whoever gets into it can get into your Perchia.
- Tell us at hola@perchia.app if you think someone has got into your account.
5. Your photos and what you upload
- What you upload is yours. Your photos, your clothes and what you write remain yours.
- To provide the service you allow us to store it, process it, send it to the providers who help us (named in the Privacy notice) and create your outfits and pictures with it. This permission is free, non-exclusive, only for providing Perchia, and ends when you delete it or your account. We don't use your photos to train AI models or for advertising, and we don't show them to anyone.
- Only photos of yourself. Upload only photos where the person being dressed is you. If someone else appears in a clothes photo, you need their permission, and it's better if their face isn't visible.
- No photos of minors, no nudity, no sexual or intimate content.
- You can delete any photo or piece whenever you like.
6. Acceptable use
You may not use Perchia to:
- upload someone else's photo to draw them or "try" clothes on them without their permission;
- create pictures of minors, or sexual, intimate, humiliating or misleading pictures of anyone;
- impersonate someone, harass, discriminate or deceive with the pictures;
- upload illegal content or content that infringes others' rights (for example, photos you have no right to use);
- try to get into other people's accounts or data, get around the limits, overload the service or extract data automatically;
- try to make Perchia's AI do something outside your wardrobe (Perchia works only with your clothes and your profile).
If we see such use, we may delete the content and suspend or close the account (point 12).
7. AI-made pictures
- Pictures of you in an outfit ("See it on me") are drawn by an artificial intelligence model from your photos. They are illustrations, not real photos. They may not show exactly the colour, size, cut, how a piece fits you, or how you look. Your real face is put back, but an edge or a difference may show.
- They carry the label "Made with AI" and a technical mark saying so. Don't remove them if you share the pictures.
- You may use them for your personal use. If you share them, you are responsible for not letting anyone believe they are real photos where that could mislead or harm someone.
- When you talk to Perchia you are talking to an AI, not a person. It can be wrong.
8. Not professional advice
- Perchia's suggestions are style suggestions, not professional image, sizing, medical or any other advice.
- Sizes and measurements are a guide; check each brand's size guide.
- The weather comes from a forecast (Open-Meteo) that can be wrong. Look at the sky before you go out.
- Needs such as pregnancy or a seated fit: Perchia ranks pieces for comfort; it gives no medical advice.
- Customs of an occasion (a wedding, a religious service) are general guidance; if in doubt, ask your host.
- What you wear is your decision.
9. What is ours
- The app, its design, the code, the Perchia brand and its texts are ours or our licensors'. You may not copy them or use them outside the service, except as the law allows.
- You may use the pictures created for you for your personal use as point 7 says. [FOR COUNSEL: rights in AI-generated outputs.]
10. Your feedback
If you send us ideas or comments ("Tell us", thumbs, surveys), we may use them to improve Perchia without owing you anything for them. What you write is handled as the Privacy notice explains.
11. Availability and changes
- We do our best to keep Perchia working well, but in the beta there may be outages, errors or lost features. We recommend downloading your data now and then (Settings → Your data).
- We may change or remove features. If a change is important, we'll tell you beforehand.
- We may end the beta with at least [30] days' notice, so you can download your data.
12. Suspension and closing
- You can stop using Perchia and delete your account at any time (Settings → Your data → Delete my account).
- We may suspend or close your account if you breach these terms seriously or repeatedly, if the law requires it, or if it is necessary to protect other people or the service. Except in an emergency, we'll tell you beforehand and say why. You'll be able to download your data unless the law prevents it.
13. Liability
- We are liable for damage we cause you by breaching these terms, as the law provides. Nothing in these terms limits your rights as a consumer or our liability where the law does not allow it to be limited (for example, for wilful misconduct, gross negligence or harm to life, health or physical integrity).
- Because the beta is free and a test version, and to the extent the law allows, we are not liable for: decisions you make based on a suggestion, a weather forecast or an AI-made picture; outages or errors normal in a test version; or how you use the pictures when you share them. 14. Governing law and courts
These terms are governed by Spanish law. If you are a consumer, you may go to the courts of your home and you keep the protection of the mandatory consumer rules that apply to you. Before making a claim, write to hola@perchia.app: we'll try to solve it.
15. Changes to these terms
If we change these terms in an important way, we'll tell you in the app with reasonable notice. If you don't agree, you can stop using Perchia and delete your account.
